ہم ۔۔تمام نوعِ انسانی۔۔۔ کواپنے اظہاراور سرحدوں کی قید کے بغیرمعلومات اور تخیلات کی تلاش، وصولی اور دوسروں کو اس سے بہرہ مند کرنے کے آسانی سے قابل ہونا چاہیے

میں اپنے خیالات کے اظہر کی آزادی کیوں ہونی چاہیے؟

اس سوال کہ جواب میں پوری کی پوری لائبریریاں وقف کی جا چکی ہیں. ابتدائی طور پر ہم چار اہم دلائل پیش کرتے ہیں:

١) انسان کی ذاتی تکمیل: تقریر اور پیچیدہ سوچ کی قابلیت انسان کو جانوروں سے ممتاز کرتی ہے. اگر ہم اپنے خیالات اور احساسات بیان نہیں کر سکتے تو ہم اپنی انفرادیت کا پوری طرح اظہار نہیں کر سکتے.

٢) سچائی: جب تک ہمیں کسی چیز کے بارے میں متعلقہ حقائق، دلائل اور راۓ سے واقف نہیں ہونگے ہم سچائی تک نہیں پہنچ سکتے. یہاں تک کہ جھوٹے اور غلط دلائل میں بھی جھوٹ کا کوئی عنصر شامل ہو سکتا ہے جس کی وجہ سے ہماری اپنی راۓ اور زیادہ واضح ہو سکتی ہے. (اصول ٥ دیکھئے)

٣) اچھی حکومت: ہم حکومت اس وقت تک اچھے طریقے سے نہیں کر سکتے جب تک ہم معاشرے میں پاۓ جانے والے تمام خیالات اور پالیسیوں کے بارے میں واقف ہوں اور ان کے بارے میں بحث کر سکیں. اور اس کے بغیر ہم مؤثر طور پر حکومت کنٹرول بھی نہیں کر سکتے.(اصول ٣ دیکھئے)

 ٤) اختلافات کے ساتھ رہنا: ہم ایک ایسی دنیا میں رہ رہے ہیں جدھر ہر کوئی ایک دوسرے کا پڑوسی بنتا جا رہا ہے یا تو ایک ہی جگہ پر رہنے کی بنا پر یا پھر آن لائن (انٹرنیٹ اور موبائل فونوں کے ذریعے). اس لئے ہمیں سمجھنا چاہیے کے ہمارے پڑوسی ہم سے کن وجوہات کی بنا پر مختلف ہیں اور یہ اختلافات کو اہمیت رکھتے ہیں. لڑائی کرے بغیر تمام اختلافات پر کھلے طریقے سے اظہار و بحث کرنا مختلف اقسام کے لوگوں کے ساتھ رہنے سیکھنے کا بہترین طریقہ ہے.(اصول ٤، ٦ اور ٧)

دفع ١٩ – (نظری اعتبار سے) ایک آفاقی معیار

‘ہم’ فارم میں [ ] ہمارے ڈرافٹ کا پہلا اصول ١٩٤٨ کے بین الاقوامی معاہدہ براۓ انسانی حقوق کے دفع ١٩ کا ایک سادہ سا ورثن ہے. اس کی وضاحت بین الاقوامی معاہدہ براۓ سول اور سیاسی حقوق کے دفع ١٩ میں بھی ہے جو کے آزادی اظہار راۓ میں مختلف قسم کی جائز پابندیوں کا احاطہ کرتا ہے. اگر آپ اس موضوع کے بارے میں اور جاننا چاہتے ہیں تو ادھر اقوام متحدہ کی طرف سے دی گئی دفع ١٩ کی ایک مستند تشریح پڑھیے.

دنیا کی زیادہ تر ریاستوں نے اس معاہدے پر دستخط کئے ہیں ماسواۓ سمال پرنٹ میں کچھ عجیب تحفظات کے علاوہ. چین نے معاہدے پر پر دستخط تو کئے ہیں پر اس کی توثیق نہیں کی ہے. سعودی عرب اور برما نے اس پردستخط تک نہیں کئے ہیں. اس کے پس منظر پر ہمارا تجزیہ ادھر پڑھیے.

اصولا اس معاہدے پر دستخط اور اس کی توثیق کرنی والی تمام ریاستوں پر اس کی پابندی کرنا ضروری ہے. عملی طور پر کچھ حکومتیں زیادہ تر وقت اس معاہدے کی پابندی نہیں کرتی جب کے ساری حکومتیں کسی نہ کسی وقت پر اس کی خلاف ورزی کرتی ہیں. ہمارے پہلے اصول کا مطلب یہ بھی ہے کہ ہم اپنی اپنی حکومتوں سے ان خلاف ورزیوں کے بارے میں پوچھ سکیں.

ان ١١٤ ریاستوں کے شہریوں کے لئے جنہوں نے اس معاہدے کے سب سے پہلے اختیاری پروٹکول پر دستخط کئے ہیں ان کے لئے یہ شکایات کرنے کا ایک فارمل طریقہ ہے. اپنے ملکوں میں شکایت کا ازالہ نہ ہونے پر شہری سیدھا اقوام متحدہ سے یہ اپیل کر سکتے ہیں کے ان کی ریاست نے معاہدے کے دفع ١٩ کی خلاف ورزی کی ہے. دلچسپ بات یہ ہے کے اس پروٹوکول پر نہ دستخط کرنے والوں میں امریکہ اور برطانیہ شامل ہے.

یورپ میں انسانی حقوق کے یورپی کنونشن کے دفع ١٠ کے بھی ملتے جلتے الفاظ ہیں. اگر آپ یورپی یونین کے ٤٧ ممالک میں سے ایک میں رہتے ہیں اور آپ کو یہ لگتا ہے کہ آپ کےآزادی اظہار راۓ کے حق کی خلاف ورزی ہوئی ہے تو آپ سٹراسبورگ میں یورپی کورٹ براۓ انسانی حقوق میں اپیل کر سکتے ہیں. بری یورپی حکومتیں بھی یورپی کورٹ کے فیصلوں سے شرمندہ ہو کر کبھی کبھی اپنے راستے درست کر سکتی ہیں. شمالی اور جنوبی امریکہ میں بھی ایسے کورٹ موجود ہیں لیکن یہ کہیں زیادہ کمزور اس لئے ہیں کو کے ان کے فیصلوں پر ملکی حکومتیں پابند نہیں ہیں. دوسرے برے اعزموں میں اس نوعیت کا کوئی کورٹ موجود نہیں.

اس کے علاوہ مختلف عالمی علاقوں کے لئے چار بین الاقوامی رپورتیر ہیں. فی الحال ان میں فرینک لا ریو (اقوام متحدہ کے آزادی اظہار راۓ کے حق کے لئے خاص رپپورتیر ہیں)، کتلینا بوٹیرو (امریکی ممالک کی تنظیم کی خاص رپورتیر براۓ آزادی اظہار راۓ)، ڈنجا مجاٹووچ (یورپی  تنظیم براۓ سلامتی اور تعاون کی نمائندہ براۓ میڈیا کی آزادی) اور پنسی ٹلاکلہ (افریقی کمیشن براۓ انسانی حقوق کی آزادی اظہار راۓ اور معلومات تک رسائی کی خاص نمائندہ) شامل ہیں.

لیکن نہ صرف آزاد بلکہ قابل….

ان سب بہترین معاہدوں میں سب الفاظ کے علاوہ ایک لفظ موجود نہیں: ‘قابل’. یہ سب بہت مناسب ہے کے آپ خیالی طور پر کچھ سب کچھ کہنے کی آزادی ہے لیکن اسلحہ لے کر پھرنے والے – چاہے وہ مافیا ہو، خفیہ ادارے ہوں، اسلامی شدت پسند ہوں یا منشیات کے گروہ – اگر آپ کو کچھ کہنے پر قتل کر دیں گے تو آپ کی آزادی صرف خیالی طور پر ہی موجود ہے. اگر آپ کے پاس انٹرنیٹ نہیں ہیں تو بھی اس کا کوئی زیادہ فایدہ نہیں ہے. (سارے لوگوں تک انٹرنیٹ کی رسائی قائم کرنا ٹم برنرس-لی اور ان کی ورلڈ وائیڈ ویب کنسورشیم کا عظیم مقصد ہے، اصول ٢ میں اور پڑھیے). اگر آپ کے ملک میں میڈیا پر کچھ امیر لوگوں یا گروہوں کا غلبہ ہے تو بھی یہ کافی محدود ہے (پی ٣ دیکھئے). اور یہ اس وقت بھی محدود ہے جب آپ کے پاس اتنی معلومات – یا اس کو سمجھنے کے لئے مناسب تعلیم – نہ ہو کے آپ اس کے ذریعے اپنے خیالات کا اظہار کر سکیں.

دوسرے الفاظ میں – اور یہ تمام اصولوں کے لئے اتنا ہی درست ہے – حقیقت یہ ہے کہ آزادی اظہار کا انحصار جتنا قانون پر ہے اتنا ہی طاقت پر بھی ہے. مؤثر اظہار راۓ کی آزادی کے لئے آپ کے پاس صلاحیت اور اختیار بھی ہونا چاہیے. اصل مشکل یہ نہیں کے آپ نظریاتی طور پر کیا کہنے کے لئے آزاد ہیں بلکے کے آپ کی کن چیزوں کو حاصل کرنے کی ‘صالحیت’ ہونی چاہیے اور آپ کس معلومات اور کن خیالات کو آگے بڑھا سکتے ہیں. اس کو اصل میں پانا اور حاصل کرنا اس سے بھی زیادہ مشکل ہے.

‘تقریر’، ‘بات’ اور ‘اظہار’ کیا چیزیں ہیں؟

جب ہم ‘آزادی اظہار راۓ’ کے بارے میں بات کرتے ہیں تو یہ ایک مختصر تشریح ہے. جب ہم ‘تقریر’ یا ‘اظہار’ کی بات کرتے ہیں تو اس میں کئی طرح کے اظہار شامل ہیں جیسے کہ لکھنا، تصویریں، نغمے، ویڈیو، فلم، جھنڈے (اور جلتے ہوئے جھنڈے)، لباس کے مختلف طور طریقے جیسے کہ حجاب، بیج، تھیٹر پرفارمنس، مذہبی عقائد اور نشان، بھوک ہڑتالیں، مظاہرے وغیرہ. آزادی اظہار راۓ کا مطلب یہ بھی ہے کہ آپ چپ رہ کر اپنے حق کا استعمال کریں – جیسے کے امریکہ میں یہووا کے گواہ جنہوں نے وفاداری کا حلف اٹھانے سے انکار اس بنا پر کر دیا کے وح اس کو اپنی مذہب کے خلاف سمجھتے تھے.

اور آپ کی اپنی زبان میں….

اظہار کی آزادی کا مطلب یہ بھی ہے کے آپ کو اپنی زبان میں بات کرنے کی اجزات ہونی چاہیے. ایک کمپنی، ادارہ یا ریاست یہ ضرور کہ سکتا ہے کے اس کے ارکان، ملازمین یا شہری ایک مشترکہ زبان سیکھیں اور کچھ جگہوں یا حالات میں ان کا استعمال کریں. کینیڈا کی طرح یہ دو سرکاری زبانیں بھی ہو سکتی ہیں. یہ معقولا لوگوں کو اپنی مادری زبان استعمال کرنے سے نہیں روک سکتا – اور اس کو ظاہری زبان، خاص گروہوں کے لباس اور نشانات وغیرہ پر صرف بہت ٹھوس وجوہات کی بنا پر حدود لگانی چاہییں. یہ جب ہوتا ہے تو یہ آزادی اظہار کے ایک بنیادی اصول کیخلاف ورزی ہے. اگر آپ اس سلسلے میں دوسرے دلچسپ کیسوں کے بارے میں جانتے ہیں تو انہیں ادھر بیان کیجئے.

اور اگر آپ جو مجھے بتانا یا دینا چاہتے ہیں اس کو میں نہیں لینا یا سننا چاہتا؟

اس اصول میں تین اہم الفاظ کے جوڑے ہیں: آزاد اور با صلاحیت، فراہم اور حصول، معلومات اور خیالات. ‘آزاد اور با صلاحیت’ کے بارے میں ہم گفتگو کر چکے ہیں: یہ قانونی حق اور مؤثر صلاحیت کے درمیان تفریق ہیں. ‘فراہم اور حصول’ میں بھی ایک ضروری فرق ہے. ایک تو اس مرد یا عورت کی آزادی ہے جو کے کچھ فراہم یا پھیلانا چاہتا ہے – چاہے وہ ایک سپیکر، بلاگر، مصنف، پینٹر، پرفارمر یاں مظاہرہ کرنے والے کے طور پر ہو – اور اس شخص کی آزادی ہے جو کے وصول کرنا چاہتا ہے – چاہے وہ ایک پڑھنے، سننے، انٹرنیٹ صارف، تی وی دیکھنے والے یا کسی شو کے شائق کے طور پر ہو. کبھی کبھی ان دونوں کے درمیان کشیدگی بھی ہو سکتی ہے. میں ہو سکتا ہے ایک ایسی چیز بتانا چاہتا ہے جس کو آپ سننا نہیں چاہتے.

کہاں تک ممکن ہو ہم دونوں کے پاس اس میں انتخاب کرنے کی آزادی ہونی چاہیے. مثلا اس ویب سائٹ پر اگر ایک ایسی چیز ہے جو کے ہم سمجھتے ہیں کہ ضروری ہے لیکن جو ہمیں پتا ہے کے بوہت سے لوگ دیکھنا پسند نہیں کریں گے ہم اس پر آپ کو کلک کرنے کا آپشن دیتے ہیں. اسی طرح اگر آپ حضرت محمّد پر چھپے ان ڈینش کارٹونوں کا وکی پیڈیا صفحہ دیکھنا چاہتے ہیں جن کی وجہ سے انٹرنیٹ اور باقی دنیا میں بہت تنازعہ کھڑا ہوا تو آپ ادھر کلک کیجئے. لیکن اگر آپ کو اس سے دکھ ہو گا تو آپ مت کلک کیجئے (پی ٧ دیکھئے). اس کا انحصار پوری طرح صرف آپ پر ہے.

لیکن ادھر کئی ساری مشکلات ہیں. وکی پیڈیا ایک خاکوں کے فلٹر پر کام کر رہ ہے جس کچھ مخصوص اقسام کی تصویروں پر بلاک لگا سکیں گے. کیا میڈیا کا ہمیں جنگ اور تشدّد کی سب سے بھیانک تصویریں نا دکھانا ایک صحیح اقدام ہے؟ کیا یہ ہمیں بلکل اس وجہ سے نہیں دکھانے چاہیے تاکے ہمیں جنگ کے خوفناک اثرات کا اندازہ ہو اور ہم اس کو روکنے کی پوری طرح کوشش کریں؟ اور ان بڑے بڑے بل بورڈوں کے بارے میں کیا خیال ہے جن پر آپ کی چلتے چلتے نظر پر ہی جاتی ہے یا وو مذہبی نشان جو کے اس سرکاری سکول کی کلاس میں لٹکا ہوتا ہے جدھر آپ جاتے ہیں؟

معلومات کی اہمیت

دفع ١٩ کی طرح ہمارا ڈرافٹ اصول ‘معلومات اور خیالات’ کے الفاظ استعمال کرتا ہے. ان میں آگ اور پانی کی طرح ایک واضح فرق تو نہیں لیکن پھر یہ مختلف ہیں. معلومات میں انسانی اور باقی دنیا کے بارے میں حقیق شامل ہیں اور وہ ڈیٹا بھی شامل ہے جو کے اکثر حکومتیں، کمپنیاں، کلیسا اور مختلف افراد ہم سے چھپانے کی کوشش کرتے ہیں (پی ٥، ٨، اور ١٠ دیکھئے). معلومات تک رسائی کی آزادی اور آزادی اظہار راۓ ایک چیز نہیں ہیں لیکن یہ آپس میں بہت قریب ہیں. اقوام متحدہ کی انسانی حوق کی کمیٹی کی طرف سے دفع ١٩ کی ایک مستند تشریح یہ کہتی ہے کے یہ ‘عام طور پر سرکاری اداروں کہ پاس رکھی گئی معلومات تک رسائی کے حق کو تسلیم کرتا ہے’. لیکن اس کا اصل مطلب کیا ہے؟

جرمنی کا آئین کہتا ہے کے لوگوں کو ‘عام طور پر قابل رسائی ذرایع سے’ اپنے آپ کو معلومات سے شانہ بشانہ رکھنے کی اجازت ہونی چاہیے. لیکن عام طور نا قابل رسائی ذرایع کا کیا ہو گا؟ اگر میری حکومت یہ کہتی ہے کہ ‘دشمن کے پاس جنگ کے لئے تیار بڑے پیمانے پر تباہی پھیلانے والے ہتیار جمع ہیں’ – تو میں انٹلیجنس تک رسائی کے بغیر حکومت کے جنگ کرنے کے اقدام کو کس طرح چلینج کر سکتا ہوں؟ معلومات تک رسائی ہماری طاقت کا احاطہ کرتی ہے.

سرحدوں سے بالاتر!

آخر میں دفع ١٩ میں یہ بھی کہا گیا ہے کہ اظہار راۓ کی آزادی ‘سرحدوں سے بالاتر’ ہے. زیادہ تر انسانی حقوق کے معاہدے کچھ یوں ہوتے ہیں کہ ‘ہم، ریاست الف یا بے، اسس بات کا عزم کرتے ہیں کہ ہم اپنے شہریوں (اور رہنے والوں) کے فلاں فلاں حقوق کی اپنی  سرحدوں کے اندر حفاظت کریں گے’. لیکن یہ معاہدہ کہتا ہے کہ ‘ہم ان سرحدوں کو پار اور دونوں طرف معلومات اور خیالات کے بہاؤ کی اجازت دیں گے’. ١٩٤٨ میں یہ کہنا جب بین الاقوامی بلکل نئی تھیں اور انٹرنیٹ لوگوں کے خوابوں میں ہی بستہ تھا ایک دور انڈیز اور قابل ذکر بات تھی. آج معلومات اور خیالات کو سرحدوں کے پار جانے یا ادھر سے آنے سے روکنے کے لئے حکومتوں کو غیر معمولی اقدامات اٹھانے پڑتے ہیں. اور بہت سی حکومتیں یہ کرتی بھی ہیں.

    I don’t agree with the principle. I’m a bit surprised that anyone does! here in the UK I have a wide range of legal and social bans on what I can say. These bans are quite widely accepted and the free speech debate is to some extent a tool to criticise the values held by other non-western societies. Let me give some examples:
    1) Should I be free to publish information about a defendant on trial?
    2) Should I be free to name a rape victim? comment on his or her behaviour? while the case is in court?
    3) Can I publish research results on skin colour variation between races? [yes] Can I do the same about conginitive attributes? – not if I want a job in a UK or US University?
    4) Can I question the roles of men and women in modern society? And still be allowed conduct job interviews as part of my job?
    6) Can I talk openly about my religious views and evangelise?
    I’m not talking about National security issues, but that we have other widely accepted, largely unchallenged laws and social rules which threaten the careers, livliehood and freedom of transgressors. I don’t think India or Arab states have more rules, just different ones.
    In many cases the rules are well-meant and intended to support justice or promote admirable changes to society. But make no mistake, they stop free expression and publication of some information.

Resolution of these queries, necessitates use of questions specifically designed to identify some fundamental requirement universal to us all. That effort then applied, coalesces as a single vector. Plus, exposure of an obvious but un-addressed flaw in our physiological construction. Which has, until now, frustrated major advancement for our kind.

    Q1. What is such a crusade intended to achieve?
    Potentially, there are as many responses to that conundrum as there are individuals to contrive them. Yet not one of those explanations, being wholly dependant or entirely reliant on the presence of humanity, can manifest without the existence of humanity. So, might ensuring the continuation of the species constitute the common purpose pursued?

    Q2. What prevents a realisation of the above?
    To function effectively in reality, human appreciations have to accommodate every aspect of existence they encounter. Else-wise, conflict will ensue from that plethora of disparate ‘understandings’ arrived at through selective appraisal. This inherent constructional defect is unfortunately not correctable. But what if, once registered in collective consciousness, it could be compensated for?

    Free Speech Disclaimer Prefacing All Principles Of Debate.
    I, in common with all other humans (evidence for concept available on application), am not ‘plugged’ directly into reality. But rather into an ‘interpreter’ interface, whose subjective output may be genuinely mistaken for said objective experience. Consequently, what follows is but a rendition of reality together with its associated workings. Additionally, given acknowledgement of the primary principle, debate is intended to ensure that those conditions conducive to species survival are maintained. Such that an inclination to suppress open discussion, as opposed to personally forswearing involvement in it, shall signify the presence of a closed ‘comprehension’. One that will not withstand comparative testing. Being likely to unnecessarily imperil species continuance, and by extension its own possessor’s longevity. (No humans, no debatable notional constructs, invented ideologies, pseudo philosophies, or any other homo sapien-powered activity).

    There are as many ways to explain a view as there are minds to interpret it. If any particular explanatory format cannot be assimilated, it is by no means the fault of an audience. All onus rests with the presenter. Who will and must, when requested, rework their mentation from as many differing perspectives as may prove necessary to achieve comprehension and reaffirmation. Truth alone is resilient to interminable debate. Which offers a clue as to why untruth is so desperate to avoid it.

    Example:
    “Professor states that democracy “always needs debate” and that the debate “plays its role” better if there are less limitations of free speech.”
    An opportunity once presented itself to ask a politician, if he considered it vital for someone in his position to possess a firm grasp of reality. He replied in the affirmative. The next query concerned whether he believed in democracy. His response confirmed that he did. When questioned as to what democracy was, he stated fairness. This prompted pointing out that a dictionary defines democracy as, “government of the people, by the people, for the people”. Or policy selection via majority mandate. So was expressing belief in something when one didn’t know what that something was, evidence of a firm grasp of reality? Sadly he was unable to spare time to even make an excuse, before fleeing.

  3. Adding ‘and able’ is a serious error. It opens the door to State intervention in the name of promoting freedom of expression which, as night follows day, will end up restricting it. No state willingly expends resources on promoting free speech without trying to stipulate the kinds of speech that its resources can be used for.

    Just listen to the politicians who insist that the right of free speech must be exercised responsibly. A fundamental right of free speech that protects only ‘responsible’ speech protects nothing worth having. Once those politicians are expending state funds to provide our internet connections the rest is inevitable.

    Please stick to the 1948 wording. For the internet, it cannot be bettered.

  8. I’ve read recently an interview given by Professor Timothy Garton Ash for Polish magazine “Polityka” – titled “Dangerous Speech” but devoted to wider spectrum of free-speech-debate matters. Among other interesting statements, with majority of which I agree, Professor states that democracy “always needs debate” and that the debate “plays its role” better if there are less limitations of free speech. But what is this role to play – that is my question. Debate is considered a key attribute of democracy, but maybe sometimes is treated as democracy’s Sacred Cow. Is it really enough if only debate exists and continues in free and civilized manner? I’m skeptical about this. If debate hasn’t any other aim than exchange of thinking, one can expect its running wild and becoming useless (another danger for participants: GBS stated that in an exchange of thinking transaction he usually was the loser). I think that the most important factor essential for democracy as a system of majority rules, making debate sound, is a debate final aim: taking a decision by ballot, just by debating body. There is an opinion that natural extension – or rather 2.0 Variant – of the first watchword of modern democracy “no taxation without representation” is the formula “no obeying a decision without to vote on it” that can be fulfilled via Internet. I agree with this opinion, and I’m convinced that in this century cybernetic assisted direct democracy, with truly fruitful debates, will become real.   9. I highly agree with this principle, and I understand how the others branch of from this one. Therefore, it is a vital one to discuss and gain a better understanding about. Personal opinions and ideas is what shapes each person as an individual and without these the world would be an extremely uniform and monotonous place. Therefore it is crucial to be able to express and communicate these ideas, even when others do not agree. Of course I admit that this is unfortunately not always the case. But as stated, we need to have the power to be able to express as well as the will. This begins by appreciating what others have to say and at the same time having the ability to accept that your own opinion is just as good as any.

  10. Thanks for this brilliant introduction to the topic. I especially appreciate to stress the signifier ‘able’ in the principle as I think that the question of power even far outweighs (!) the question of law.

  11. Hi everyone, I’m the first who comments in this section. On the one hand, I do not understand how such a site is deserted by all who have the desire to communicate and share their thoughts with anyone, freely, but soon after, I realize that everything the web has fallen upon us with a so quickly that we do not have a clear vision of what the web, or what is the chance to express themselves freely. Freedom from whom? The concept of freedom is so far away that it is difficult and self-talk. Personally, I hope for a worldwide deployment of this platform to be, regardless of whether they agree on one or more themes.
