خط را کجا بکشیم؟
اصل بیستم میثاق بینالمللی حقوق سیاسی و مدنی تصریح میکند که دولتها باید “هر گونه طرفداری از انزجار مذهبی، نژادی یا ملی که منجر به تبعیض، دشمنی یا خشونت میشود” را ممنوع کنند. این اصل جای زیادی برای تفسیر و توضیح باقی میگذارد. ایالات متحده آمریکا سد بلندی برای مقوله برانگیختن خشونت میسازد. درمقولهای که با عنوان “آزمون برندنبورگ” (بعد از دادگاه مورد برندنبورگ در اوهایو) شناخته میشود، خشونت باید عمدی و برنامهریزیشده، محتمل و قریبالوقوع باشد. سایر حکومتهای پرتجربهتر لیبرال دموکرات این مرز را پایینتر میگذارند و اشکال تعمیمیافتهتری از تهدیدهای خشونتآمیز و انواع گفتاری که برانگیزاننده خشونت و نفرت هستند را جرم میانگارند.
درست مثل هر چیز دیگری که به آزادی بیان مربوط میشود، همه چیز تا حد بسیار زیادی بستگی به شرایط و لحن دارد. متفکر لیبرال انگلیسی، جان استیوارت میل در بحث مشهوری میگوید که ما باید در انتشار مقالهای در روزنامه در حمایت از اینکه دلالان ذرت، گرسنگان مستضعف جامعه هستند، آزاد باشیم ولی آزاد نیستیم که همین حرف را به جماعتی هیجانزده که در مقابل خانهی یک دلال ذرت تجمع کردهاند بگوییم (معادل امروزی آن سرمایهدار بانکی است)
وقتی خوانندگان روزنامه گاردینِ بریتانیا، در صفحهی نخست این تیتر را میبینند: “چارلی بروکر: سیمون کوول را اعدام کنید و مواد غذایی را توزیع کنید”، آن را به عنوان تحریک در جهت قتل کسی نمیخوانند و میدانند که چنین حرفی صرفاً یک شوخی است، اما وقتی دیکتاتور لیبیایی، معمر قذافی تهدید کرد که به شهر بنغازی “کوچه به کوچه” و بدون نشان دادن “هیچ عفو و ترحمی” حمله خواهد کرد همه میدانستند که چنین حرفی شوخی نیست.
یکی از موارد افراطی ترویج خشونت بیان، مورد رادیو تلویزیون «لیبر دی میل کولینز» در رواندا است که گنگهای کشتار هوتوس را از طریق فرستادن امواج رادیویی برای “جنگ نهایی” جهت “قلع و قمع کردن سوسکها” به کشتن هشتصدهزار نفر از توتسیسها (و هوتوسهای میانهرو) ترغیب کرد. حتی اگر فکر کنید، بر اساس اولین اصل سنت آمریکایی، ما فیالواقع باید در توصیف سایر گروهها به عنوان “سوسکها” (ر.ک اصل چهارم) آزاد باشیم، اما هنوز هم معتقدید که جلوی چنین حرکتی باید گرفته میشد. خشونت، قطعی، محتمل و قریبالوقوع بود.
شرایط متنی (کانتکست) همچنین به این معناست که آیا رسانه باز و متکثر از آن نوعی که در اصل سوم از آن سخن گفتیم داریم؟ گفتار تحریکآمیز و تنفربرانگیز، میتواند به وسیله گفتاری بهتر در سایر رسانههای تأثیرگذار مورد مقابله قرار گیرد. یکی از شاهدان عینی در تلاش جهت نشان دادن وحشیگری صربستان زمانی تحت حکومت دیکتاتور برگزیدهاش میلوسویچ بود، میگوید: “تصور کنید اگر کلیه کانالهای تلویزیونی در آمریکا، در پنج سال اخیر توسط کلوکلوکس کلن اشغال شده بود”. سوزان بینچ یک آزمون پنج قسمتی برای تشخیص اینکه چه زمانی گفتار خشونتآمیز تبدیل میشود به آنچه او “گفتار خطرناک” میخواند، ، طراحی کرده است. گفتار خطرناک در اینجا به معنای گفتاری است که احتمالا به خشونت منجر میشود.
بر حسب اتفاق، اینجا بیشتر درباره خشونت افراد و گروهها سخن میگوییم، نه حکومتها. اگرچه اصل بیستم میثاق بینالمللی، به وضوح تآکید میکند که “هر گونه تبلیغی برای جنگ باید به وسیله قانون ممنوع شود”، تعداد بسیار کمی از کشورها قوانینی برای محدود کردن رهبران خودشان در زمینه تبلیغ و شرکت در جنگ دارند (البته بعضی کشورها درباره اینکه چگونه باید در این باره رفتار کنند قوانینی دارند)
در تقابل با حق وتوی آدمکشی
مانند سایر اصول، این اصل نیز به دنبال تعریف دقیق اینکه قانون چه چیزی را باید یا نباید ممنوع کند نیست، بلکه صرفاً حسابی سرانگشتی برای راهنمایی خودمان است. این اصل دو بخش دارد: ۱- تهدیدهای خشونتبار نمیکنیم. ۲- به تهدید خشونتآمیز مجوز نمیدهیم، آن را نمیپذیریم و در مقابل آن تسلیم نمیشویم. این دو بخش دو روی یک سکهاند. اگر تسلیم یک تهدید خشونتبار شوید، تهدید خشونتبار دیگری را ترغیب کردهاید. گروه «ب» که با شور و حرارت تمام احساس میکند که فلان حرف نباید گفته یا تشریح میشد، به خودش میگوید: “آه! گروه الف، ‘ایکس’ را با تهدید خشونتآمیز متوقف کرد، ما هم باید همین کار را بکنیم”.
در نوشتههای مربوط به آزادی بیان، مفهوم از مدافتادهی حق وتوی کسانی که جلسات سخنرانی سیاسی را به هم میزنند وجود دارد. اگر جلسهبههمزنان حق فریاد کشیدن در سخنرانی کسی را داشته باشند، در واقع حق حرف زدن را از سخنران سلب میکنند. این روزها بیشتر آنچه میبینیم حق وتوی آدمکشهاست. افراد یا گروهها این پیام ساده را میفرستند: “اگر فلان چیز را بگویی، تو را میکشیم”. بعضی وقتها آنها به وعده خود عمل میکنند. صدها زن و مرد در سراسر دنیا صرفاً به خاطر حرفهایی که زدهاند به قتل رسیدهاند- نویسندگان درباره مافیا، منتقدان و طنزپردازان ادیان و رژیمهای مختلف، مخالفان، کارتونیستها، ناشران، رماننویسان و روزنامهنگاران جستجوگر. بسیاری دیگر نیز در خوف حق وتوی این آدمکشها زندگی میکنند.
ارعاب و تسلی
دو نیمه این اصل وزن یکسانی دارند. ما همانقدر که موظف به مقاومت دربرابر تهدیدهای خشونتباریم، در برابر اجتناب از ایجاد آنها هم مسوولیت داریم. از این لحاظ بسیاری از کشورهای به اصطلاح آزاد در سالهای اخیر بسیار بد عمل کردهاند. این کشورها به طور متناوب، به جای برخورد همه جانبه از طریق قانون و اراده یک جامعهی متحد، گاهی به اسم احترام به ادیان (ر.ک اصل هفتم )و گاه به اسم همبستگی گروهی، نظم عمومی یا تکثر فرهنگی، تهدیدهای تلویحی یا آشکار خشونتبار را فرونشاندهاند.
نمونهی اعلای این نوع تسلیبخشی نابجا چندی پیش توسط انتشارات آمریکایی دانشگاه ییل فراهم شد. ییل میخواست کتاب تحقیقی بسیار جدیای درباره کارتونهای دانمارکی راجع به محمد را به نام “کارتونهایی که دنیا را لرزاند” منتشر کند. تعدادی نمونه تصویری آماده شد که تصویر کامل صفحه روزنامه دانمارکی جیلاندز-پوستن، ناشر کارتونها را دوباره منتشر میکرد، بر آن اساس میشد کارتونها را در کانتکست اصلیشان دید و همچنین امکان مشاهده اولین تصویرسازیها از محمد در هنر اسلامی و غربی و ارائه دیدگاه گستردهتر تاریخیای را ایجاد کرد. چندی قبل از انتشار (مصاحبه با جیت کلاسن)، دانشگاه ییل و انتشاراتاش تصمیم گرفت که تصاویر را حذف کند. بنابراین چیزی که خواننده اکنون در کتابی باعنوان “کارتونهایی که دنیا را لرزاند” نمیتواند ببیند، کارتونهایی است که دنیا را لرزاند.
ناشر، در بیانیهای، از “کارشناسان وزارت اطلاعات، امنیت ملی، مجریان قانون و کارشناسان امور دیپلماتیک و نیز تعدادی از محققان مشهور در زمینه مطالعات اسلامی و خاورمیانه” نقلقول کرد. آنها ظاهراً بر این نظر بودند که با بازنشر کارتونها، انتشارات ییل، “ریسک برانگیختن خشونت” را در پی خواهد شد. رییس انتشارات دانشگاه ییل، جان دوناتیچ، گفت که او هرگز از زیر بار مجادله شانه خالی نکرده است، “ولی زمانی که بحث بین شانه خالی کردن از زیر مجادله و آلوده شدن دستهایم به خون باشد، جایی برای سوال باقی نمیماند”.
این بحث فقط مغشوش نیست، بلکه حاوی تناقض هم است. این انتشارات دانشگاه ییل نیست که خشونت را “برمیانگیزد”، بلکه کسانی برانگیزاننده خشونت هستند که (احتمالاً) در واکنش به عملکرد کاملاً عقلانی انتشارات دانشگاه ییل دست به تهدید خشونتبار زدهاند. این دوناتیچ نیست که در یک عمل خشونتبار “دستانش به خون آلوده باشد” ، بلکه کسانی دستشان به خون آلوده است که خشونت را مرتکب شدهاند. مقصر این داستان، قربانی نیست. اگر انتشارات یک دانشگاه ممتاز حاضر به انتشار چنین مطلبی در یک مطالعه علمی نباشد (همچنین بنگرید به اصل پنجم)، . برانگیزندهی خشونت برنده این داستان بوده است. متأسفانه، نمونههای زیادی از این دست در رسانه، هنر، گروههای محلی برخی از آزادترین کشورهای دنیا قابل مشاهده است، نیازی به توضیح نیست که چنین نمونههایی در کشورهای کمتر آزاد یا غیرآزاد هم بسیار یافت میشود.
یک پرونده حقوقی مربوط به سال ۱۸۸۲ در انگلیس این ابهام را روشن میکند. یک سپاه رستگاری مذهبی، به جرم پیش بردن پروژهای که بارها قبل از این، با خشونت توسط یک گروه مخالف که با افتخار «ارتش اسکلت» نامیده میشد، متوقف شده بود، دستگیر شدند. دادگاه انگلیسی حکم کرد که پلیس باید ارتش اسلکت را که محرک خشونت بوده منع میکرده نه سپاه رستگاری مذهبی که مفعولِ تحریک خشونت بوده است. این حکم میتواند به کلیه قارههایی که در زمان ما موجود است تعمیم داده شود: سپاههای رستگاری خود را متوقف نکنید، در عوض جلوی سپاههای اسکلت خود را بگیرید.
شجاعت و همبستگی
مقاومت در برابر خشونت نیازمند قاطعیت جدی قانون است. این امر نیازمند پلیسی است که به جای اینکه کسانی که مورد تهدید قرار گرفتهاند را خفه کند از آنها محافظت کند. این قضیه همچنین نیازمند شجاعت اشخاصی استثنایی است که ریسک میکنند و گاهی از زندگی خودشان در راه آزادی بیان میگذرند: افرادی مانند روزنامهنگار روسی، آنا پلیتکوسکایا، فرماندار پنجاب، سلمان تاسیر، روزنامهنگار ترک ارمنی، هرانت دینک و فعال حقوق محیط زیست برزیلیچیکو مندس. امکان فهرست کردن نام همه این افراد در اینجا نیست ولی لطفاً به این لیست اسم اضافه کنید، به همراه توضیحی درباره اینکه چرا فکر میکنید این اسامی به این لیست تعلق دارند.
با این حال این افراد جسور و شجاع مانند دولتها به تنهایی قادر به مقابله با خشونت نیستند. عنصر اصلی سوم اتحاد جوامع و گروهها است. هر چه بیشتر انسانها بار ارعاب و ترس را بین خودشان تقسیم کنند، آن بار کوچکتر و سبکتر میشود. وقتی یک نفر به نام خالد الجوحانی، به تنهایی در عربستان سعودی، بر سر عقیده خودش ایستاد و به زندان افتاد، اما وقتی که بیش از یک میلیون نفر در میدان التحریر مصر کنار هم ایستادند، این حسنی مبارک، برانگیزاننده خشونت بود که سرنگون شد.
این اتحاد، نیازمند موافقت با دیدگاههای کسانی که نظرشان را آشکارا ابراز میکنند نیست. چرا که مخالفان اغلب دیدگاههای شدیداً ناسازگاری با هم دارند و موافقت همهجانبه با دیدگاههای یکدیگر به لحاظ منطقی امکانپذیر نیست.
برای مثال، شما نمیتوانید همواره با دیدگاههای دو گروه اصلی ضد شوروی، الکساندر سولژنیستین و اندری ساخاراف همراه و موافق باشید، چرا که این دو گروه به طور بنیادی با یکدیگر مخالف بودند، ولی میتوانید از هر دوی آنها حمایت کنید. جمله مشهوری وجود دارد که به ولتر نسبت دادهاند: “من با آنچه تو میگویی مخالفم، ولی تا سرحد مرگ از حقوق تو برای ابراز نظرت حمایت میکنم”. واقعیت این است که ولتر چنین جملهای را هیچ وقت نگفته است- این جملهی ضربالمثلگونه توسط یک بیوگرافینویس اوایل قرن بیستم نوشته شده است- اما روح نهفته در این حرف ساختگی کاملاً صحیح است. ما هماکنون به چنین روحی بیش از هر زمان دیگری محتاجیم.
گرچه همیشه از موردی به مورد دیگر و در شرایط متفاوت جایی برای تفسیر باقی میماند، اما این یکی از سادهترین و در عینحال از سختترین اصول ماست وقتی که پای عمل در میان است. شما میتوانید برای پیروی از چنین اصلی جانتان را از دست بدهید.

Hello All,
I don’t know a great deal about all this and I’m sort of rushing through with a speed read and a quick reply. I think there are different varieties of violence, and sometimes a mixture of those varieties. I am of the strong belief that some people are inherently more violent than others, for medical reasons. Their childhood can be a big part of things. What I would call social leisure violence, such as football hooliganism, is a particular type that has spread out with the advance of media technology. War is another type of violence which is state organised, which tends to be re labeled and glorified as much as possible. Where government are involved, there many fine speeches made and many new words for violence used. Guantánamo Bay for example was an act of pure highly organised violence and false information that inhibited free speech. This together with the tenure of President Trump has set new values; or the lack of them. The global population has always been about the have and have not. Technology has taken us a long way, but greed and violence will increase across the world. Drugs and alcohol are certainly a major factor in the Streets of the UK where I live and no doubt across much of the world.

When dreaming, we are prepared to accept the most preposterous and nonsensical of ‘experiences’ as reality. Possibly because, until we wake, there is nothing against which to compare the encounter occurring inside an hermetically sealed enclosure. Similarly the interweb has, at the very minimum, proffered an alternate. One that although not necessarily without error, might at least indicate when it is being interfered with. Since where contrast should be found, there will only be uniformity of opinion.
“If you find a site is blocked”
it is a sure and certain sign that an ‘understanding’ is being artificially protected and maintained. Because unlike self supporting truth, it cannot stand up to even elementary enquiry? Such as: Please share with the rest of us, that infallible procedure you utilised to confirm your elected ideology’s validity. That we might embrace that evaluation peacefully, without the need for duress.

Given that their ‘comprehension’ constitutes a perfect representation of reality. Surely allowing others to test it, and thus affirm that actuality, would be the ideal means for disseminating it around the planet. Anything else would be an open admission of doubt, or downright certainty concerning its lack of legitimacy.

Yet refuse to submit their own ideologies to intimate examination? Which may explain, why those they are in conflict with cannot see a reason they should offer their notions up for objective evaluation either.

But also an Achilles’ heel, in the form of a vulnerability to mass boycott?
“we can lobby our governments to change their laws”
Some say that if voting had any effect it would be prevented. Might they be drawing that conclusion from examples such as ‘EU referendums’?
What we appear to be attempting, is analogous to collectively assembling a jigsaw puzzle. Which might prove easier, were we to first identify and agree on the scene we are jointly endeavouring to recreate.

The internet is an amazing innovation with no precedent and any limitations upon it would be a shame. To limit it slightly would be to set in action a cascade of fetters that would shatter everything the Internet could have been.

If we think of what the idea of the internet was in the beginning, the vastest storage of information shared among the whole world, of course it is normal to assume that it would become a vastest opportunity for innumerate crimes. But the basic idea, the true meaning of the whole invention is so valuable and must be absolutely preserved.
Between the concept of abuse and freedom of speech there’s sometimes a very thin line, but it is always more important to say it all than to oppress ideas.
Liberty that has been given to some of the big, like Google, and their “privacy respect” is always questionable, like it happened these days in GB, with admitting that Google car has been collecting (and selling) more info than actually needed for “filming the streets”.
Any clerk with access to information, can always be willing to sell them for a good offer (remember the Swiss bank account holders’ information scandal…). It is just something that can not be stopped. But it must be fought and punished.
We all deserve to see/read/hear everything that might (or even that might not) interest us, and judge ourselves upon it. Let’s try to keep it that way.

I share the importance of preventing the abuse of the content , however like in the comment above the dilemma of what should be considered as an abuse and who should define it is a big deal. And I think there is division in term of the priorities around that world. In the developed countries where there is a reasonable freedom of speech the abuse from the private side is more of an issue than in those countries where there is a constant state repression of the freedom of expression online. Moreover, this type of control does not guarantee protection of the other forms of abuse like child pornography. Thus I believe we the netizens should aim for liberating the online space to allow as much freedom of opinion expression as possible, even if it is at the cost of the abuse.

I agree with you that we have to consider different countries and their cultures. It is very hard to generalise the principles, because it may be that some parts of the world have a completely different view than other parts. So it is quite a challenge to agree on ten principles globally and it is also interesting. I also agree that we have to try to have media which are as open as possible, but I disagree with you that it is even at the cost of the abuse. We have to differentiate between the freedom of speech and abuse. Therefore we have to define principles globally in order to be able decide globally whether this “speech” is accetable or an abuse.
Ich stimme Dir zu, dass wir verschiedene Länder und deren Kulturen berücksichtigen müssen. Es ist sehr schwer, die Prinzipien zu verallgemeinern, weil es sein kann, dass einige Teile der Welt eine ganz andere Meinung als andere Teile haben. So ist es durchaus eine Herausforderung, auf zehn Prinzipien global zustimmen und es ist auch interessant. Ich stimme auch zu, dass wir versuchen, die Medien so offen wie möglich halten müssen, aber ich stimme Dir nicht zu, dass es auch um den Preis des Missbrauchs ist. Wir müssen zwischen der Freiheit der Rede und Missbrauch unterscheiden. Deshalb müssen wir Prinzipien global definieren, um in der Lage zu sein zu entscheiden, ob diese global “Rede” annehmbare oder ein Missbrauch ist.

The question of legitimacy is indeed very tricky.
Public powers should indeed have the power to ‘legitimately’ restrict certain information. Taking an extremely libertarian approach claiming that all information should be ‘free’ is far from the pragmatic reality.
I would even argue that as the question of legitimacy is such a delicate question that it is virtually impossible to define it in a general principle. When using a phrase like ‘for the greater good of the public’ to define the legitimacy of restricted information, executive powers might however be prone to exploit this principle.

In Italy, two days ago, a lawyer denounced the President of the Republic, the Head of Government, all Ministers and all the Members for:
– Attack on the integrity, independence and unity of the State;
– Subversive associations;
– Attack on the Constitution of the State;
– Usurpation of political power;
– Attack on the constitutional bodies;
– Attack on the political rights of citizens;
– Political conspiracy by agreement;
– Political conspiracy by association;
but … only one independent newspaper broke the news!

I’m here to tell the denied freedom of the press in Italy. This is a real problem.
The censorship has reached unbearable levels! After the Treaty of Lisbon and the approval of the ACTA treaty, by the European Union, the only resource we have left to procure a real informaizoni is the net…but it also wants to censor the web!
The project began long ago and came to the public through the bills SOPA and PIPA at the U.S. Congress. In Italy two politicians have already tried to censor the web through the fight pro-copyright.
It’s necessary that we speak.

This explanation appears a particularly net-centric view for a principle that includes “all other forms of communication” ?
And, why the overly complicated language regarding corruption – “illegitimate encroachments” – why not just corruption. In seeking to define, a principle should not be limited by complexity.
