ما انسانها همه باید ازاد باشیم و بتوانیم ازادانه افکار و عقاید و نظراتمان را بیان کنیم وعلیرغم حدومرزها بتوانیم اطلاعات را پیگیری, دریافت و ابلاغ نماییم.

چرا ما باید بتوانیم عقاید خود را آزادانه بیان کنیم؟

کتاب‌های زیادی در پاسخ به این سؤال نگاشته شده‌ است. در اینجا چهار استدلال مهم را برای شروع برمی‌‌شماریم:

1. ارضای روح بشری : قوه ناطقه و تفکر انتزاعی حیوانات و انسان‌ها را از یکدیگر متمایز می‌کند. اگر ما نتوانیم افکار و احساسات خود را بیان کنیم، قادر نخواهیم بود وجود فردی و انسانی‌ خود را به طور کامل بشناسیم.

2. حقیقت : ما نمی‌‌توانیم به حقیقت دست یابیم مگر آنکه به دیگر واقعیات، نظرات و استدلال‌های مربوطه دسترسی داشته باشیم. حتی سخن دروغ هم می‌‌تواند بارقه‌ای از حقیقت را در بر داشته باشد یا ما را بر انگیزاند تا پاسخ‌ بهتری داشته باشیم (ر.ک اصل 5)

3. حاکمیت مطلوب: ما نمی‌‌توانیم بر سرنوشت خود حاکم باشیم مگر آنکه بتوانیم آزادانه به انواع دیدگاه‌ها و خط مشی‌های سیاسی درون و برون از جامعه خود دسترسی داشته باشیم. در غیر این صورت نخواهیم توانست به گونه‌ای مؤثر حاکمیت خود را کنترل کنیم (ر.ک اصل3)

4. زندگی‌ با تفاوت‌ها : ما درجهانی‌ زندگی‌ می‌‌کنیم که افراد گوناگون روز به روز به یکدیگر نزدیک‌تر می‌‌شوند؛چه به شکل حضوری‌ مانند مسافرت و مهاجرت و چه در فضای مجازی و از طریق وسایل ارتباط جمعی‌. بدین سبب ما باید در یابیم که دیگران از چه جهاتی با ما متفاوت هستند و چرا این تفاوت‌ها برایشان اهمیت دارد. آزادانه صحبت کردن دربارهٔ گوناگونی‌های جامعه انسانی‌ بهترین راه آموختن چگونگی‌ زندگی‌ با تفاوت‌هاست (ر.ک اصول 4، 6 و 7)

 اصل 19 – یک استاندارد (نه چندان) جهانی‌

پیش‌نویس اصل نخست ما، نسخه ساده شده اصل 19 اعلامیه جهانی‌ حقوق بشر در سال 1948 است. در اصل 19 پیمان بین‌المللی حقوق مدنی و سیاسی در سال 1996 نیز به شرح آن پرداخته است و در آن انواع محدودیّت‌های قانونی‌ بر آزادی بیان مشخص شده است. چنان‌چه تمایل دارید که در این زمینه بیشتر بدانید، می‌‌توانید تفسیری بسیار معتبر از اصل 19 را که توسط کمیته حقوق بشر سازمان ملل متّحد نوشته شده است در اینجا بخوانید.

اغلب دولت‌ها عضو رسمی‌ این پیمان هستند، هرچند برخی هم نگاه گذرایی به آن داشته‌اند. کشور چین آن را امضا کرده اما به تصویب نرسانده است.عربستان سعودی و برمه حتی آن را امضا نکرده‌اند. تحلیل ما را در اینجا بخوانید.

در تئوری، این پیمان برای کشور‌هایی‌ که آن را امضا کرده و به تصویب رسانیده‌اند الزام قانونی‌ دارد. اما همان‌طور که می‌دانیم، در عمل بسیاری از دولت‌ها در اکثر مواقع و همه دولت‌ها در بعضی‌ مواقع به تعهدات خود عمل نمی‌‌کنند. اصل اول ما همچنین بدین معنی‌ است که ما این حق را داریم که از دولت‌های خود سؤال کنیم به چه دلیل تعهدات خود را نقض می‌‌کنند.

در این راستا، بایستی برای شهروندان 114 کشوری که اولین پروتکل اختیاری پیمان را امضا کرده و به تصویب رسانیده‌اند مسیری رسمی‌ طی‌ شود. این شهروندان می‌‌توانند مستقیماً به کمیته حقوق بشر سازمان ملل متحد مراجعه کرده و اعلام کنند که کشورشان بند 19 پیمان را نقض کرده است. جالب توجه آن است که ایالات متحده آمریکا و بریتانیا از جمله کشور‌هایی‌ هستند که این پروتکل را امضا نکرده‌اند.

در اروپا، در بند 10 کنوانسیون‌ حقوق بشر اتحادیه اروپا نیز از عباراتی مشابه استفاده شده است. اگر شما شهروند هر یک از 47 کشور عضو اتحادیه اروپا باشید، می‌‌توانید در صورت نقض آزادی بیانتان، به دادگاه اروپایی‌ حقوق بشر در استراسبورگ شکایت کنید. بعضاً دولت‌های بدنام اروپا هم از حکم این دادگاه شرمسار می‌شوند و گاه روش‌های خود را اصلاح می‌کنند. شمال و جنوب قاره آمریکا نیز از چنین دادگاهی برخوردارند، هرچند بسیار ضعیف‌تر، چراکه احکام این دادگاه برای هیچ یک از دادگاه‌های ملی‌ التزامی ایجاد نمی‌‌کند. در قاره‌های دیگر چنین ساختاری دیده نمی‌شود.

علاوه بر این، چهار گزارشگر بین‌المللی برای مناطق مختلف وجود دارند. در حال حاضر، این افراد عبارتند از فرانک لا رو ( گزارشگر ویژه در مسائل مربوط به حقوق آزادی بیان و عقیده)، کاتالینا بترو (گزارشگر ویژه سازمان ایالات متحده آمریکا در مسائل مربوط به آزادی بیان)، دونا میاتویچ (نماینده ویژه سازمان امنیت و همکاری در اروپا در مسائل مربوط به آزادی مطبوعات) و پنسی تلکولا (گزارشگر ویژه کنوانسیون آفریقایی حقوق بشر و حقوق مردم در مسائل مربوط به آزادی بیان و دسترسی به اطلاعات).

آزادی در کنار توانایی

ما به اصل خود یک کلمه مهم و حیاطی اضافه کرده‌ایم که در دیگر بیانیه‎‌ها و اعلامیه‌ها به چشم نمی‌خورد، و آن  کلمه، «توانایی» است. اینکه شما در عالم نظر آزاد باشید که هر چه دلتان می‌خواهد بگویید بسیار خوب است، اما اگر گروه‌های فشار محلی – مانند مافیا،  پلیس مخفی، اسلام گرایان افراطی و یا قاچاقچیان مواد مخدر– بخواهند شما رو به خاطر گفتن آنها به قتل برسانند، در این صورت آزادی شما فقط در همان عرصه نطر باقی می‌ماند. وقتی که شما هیچ دسترسی به اینترنت ندارید، دیگر فرق نمی‌کند که چقدر آزادی در فضای مجازی داشته باشید.(دسترسی همگانی به اینترنت هدف بزرگی است برای Tim Berners-Lee و وبسایتش World Wide Web Consortium ، برای اطلاعات بیشتر ر.ک اصل 2) اگر رسانه‌های کشور شما در تصرف تعداد محدودی از افراد، شرکت‌ها و یا گروه‌های ثروتمند باشند، (ر.ک اصل3)؛ همچنین اگر شما دسترسی به اطلاعات کافی و یا آموزش لازم برای تحلیل آن اطلاعات برای بیان دیدگاه خود نداشته باشید، همه اینها محدودیت‌های بسیاری است.

به عبارت دیگر، واقعیت آزادی بیان همان‌قدری که به قانون می‌پردازد، در مورد توانایی انجام آن نیز می‌باشد. (این نظر در همه اصول ده گانه ما جریان دارد). برای آنکه یک آزادی بیان مؤثر داشته باشیم، می‌بایست همان اندازه که به شما حق داده شده، توانمند هم شده باشید. دشواری اصلی‌ در تبیین نیازها و چگونگی‌ رسیدن به این «توانایی» جهت دسترسی به اطلاعات و بهره‌مندی از آن، می‌باشد. و از آن دشوارتر، تأمین کردن و به ثمر رساندن این نیازهاست.

“بیان” یا “ابراز عقیده” چیست؟

وقتی ما می‌گوییم “بحث آزادی بیان”، در واقع به اختصار سخن گفته‌ایم. با لفظ “بیان” یا “ابراز عقیده” ما کلیه صور ابراز عقیده را در نظر داریم: نوشته، تصویر، آهنگ‌، ویدئو، فیلم، پرچم‌ ( و پرچم‌های سوخته)، اشکال مختلف پوشش مانند روسری، نشانه‌ها، اجراهای نمایشی، مناسک دینی و نمادها، اعتصاب غذا، تظاهرات و بیش از آن. آزادی بیان همچنین به معنای حق شما در ابراز عقاید خودتان از طریق حرف نزدن است- مانند شاهدان یهوه در آمریکا که از یادکردن سوگند وفاداری خودداری کردند، چون آن را خلاف مذهب‌شان می‌دانستند.

به زبان خودتان

آزاد بودن در ابراز عقیده به معنای استفاده از زبان خودتان هم هست. یک حکومت، سازمان یا کمپانی می‌تواند مسوولانه از شهروندان، اعضا و کارمندانش تقاضا کند که زبانی مشترک را بیاموزند و از آن در موقعیت‌های خاص استفاده کنند. این زبان حتی می‌تواند دو زبان رسمی باشد، آن‌چنان که در کانادا مرسوم است. این زبان مشترک نمی‌تواند افراد را وادار کند که از زبان مادری خودشان استفاده نکنند- و فقط به دلایل بسیار خاصی باید استفاده آن‌ها از زبان‌های تصویری، نمادهای مهم متعلق برخی گروه‌ها، لباس‌ها و غیره را محدود کند. رخ دادن این اتفاق، به معنای نقض اصول بدیهی آزادی بیان است. اگر شما موارد دیگری از این دست می‌شناسید، لطفا در اینجا آنها را تعریف کنید.

اگر من نخواهم اطلاعات شما را دریافت کنم چه؟

در این اصل، سه جفت کلمات مهم وجود دارد: «آزاد و توانمند»، «دریافت و انتقال»، «اطلاعات و نظرات». درباره آزاد بودن و توانستن حرف زدیم که میان حق قانونی و توانایی واقعی بر انجام آن تفاوت وجود دارد.  دریافت و انتقال هم نقطه تمایز مهمی است. آزادی مرد یا زنی که می‌خواهد چیزی را بیان کند- اعم از سخنگو، نویسنده، وبلاگ‌نویس، نقاش، معترض یا  بازیگر- و آزادی کسی که می‌خواهد چیزی را دریافت کند – به عنوان خواننده، مستمع، کاربر اینترنت، بیننده تلویزیون یا تماشاچی. بعضی اوقات بین این دو تنش به وجود می‌آید. ممکن است من بخواهم چیزی را منتقل کنم که شما نخواهید آن را دریافت کنید.

تا جایی که ممکن است هر دوی ما باید آزاد باشیم که انتخاب کنیم. به طور مثال در این وبسایت، وقتی چیز مهمی هست اما می‌دانیم برخی افراد به شدت ترجیح می‌دهند که آن را نبینند؛ شما مختار هستید که کلیک کنید یا نکنید. پس برای دیدن صفحه ویکی‌پدیای کارتون‌های محمدِ پیامبر که انتشار آن‌ها در روزنامه دانمارکی ژیلندزپاستن و سپس در اینترنت منجر به جنجال و رسوایی شد اینجا را کلیک کنید. یا اگر به حساسیت‌های مذهبی شما توهین می‌شود کلیک نکنید.(ر.ک اصل7) به خودتان بستگی دارد.

اما در این باب دشواری‌های بسیاری وجود دارد. خود ویکی‌پدیا بر روی نوعی فیلتر تصویر کار می‌کند، که به کاربران بالغ یا خانواده‌های دارای فرزند امکان این انتخاب را می‌دهد که برخی  تصاویر را نبینند. آیا این درست است که بیشتر رسانه‌ها باید اکثر تصاویر دلخراش جنگ و شکنجه را نشان ندهند؟ آیا ما نباید دقیقاً با آن‌ها مواجه شویم تا بدین طریق کاملاً وحشت ناشی از آن را درک کنیم و برای بازداشتن آن هر زمانی که ممکن است دست به کار شویم؟ بیلبوردهای عظیمی که شما به سختی هنگام راه رفتن در خیابان متوجه آن می‌شوید یا نماد مذهبی‌ای که در کلاس درس یک مدرسه عمومی که شما باید به آن بروید چه‌طور؟

اهمیت اطلاعات

همانند بند ۱۹، در اصول ما نیز «اطلاعات و نظرات» ذکر شده است. این تمایز به وضوح اختلاف آب و آتش نیست، اما یک تفاوت وجود دارد. اطلاعات شامل وقایع درباره جهان فیزیکی و بشری و داده‌هایی می‌شود که حکومت‌ها، کمپانی‌ها، کلیسا‌ها و اشخاص اغلب ترجیح می‌دهند به عنوان راز حفظ کنند (ر.ک اصول ۵-۸-۱۰). آزادی اطلاعات دقیقاً همان آزادی بیان نیست، ولی ارتباط خیلی نزدیکی با آن دارد. تفسیر معتبر بند ۱۹ توسط کمیته حقوق بشر سازمان ملل می‌گوید که از حق عمومی دسترسی به اطلاعاتی که توسط نهادهای عمومی نگهداری می‌شود، استقبال می‌کند. ولی این دقیقاً به چه معناست؟

قانون اساسی آلمان می‌گوید که مردم باید آزاد باشند تا از “منابع در دسترس عموم” آگاه شوند. اما در مورد منابع غیر قابل دسترس چه‌طور؟ من چگونه می‌توانم به شکل مؤثری دولتم را برای شرکت در جنگ به چالش بکشم، آن موقع که رییس دولت می‌گوید:  “اطلاعات ما می‌گوید که دشمن سلاح  کشتار جمعی آماده برای جنگ دارد”- ولی ما اجازه نداریم بدانیم که آن اطلاعات چه هستند؟ (مورد بلر و جنگ عراق). ناموزونی در دسترسی به اطلاعات، به نوعی به ناموزونی در قدرت می‌انجامد.

بدون توجه به مرزها

بند ۱۹ می‌گوید که آزادی بیان “بدون توجه به مرزها” مطرح است. بیشتر قراردادهای حقوق بشر به این شکل هستند که: “ما، دولت الف یا ب، قسم می‌خوریم که به حقوق جیم و دال شهروندانمان (یا ساکنان) در داخل مرزهای خودمان احترام بگذاریم”. دیگری می‌گوید:‌ “ما به نظرات و اطلاعات اجازه انتشار در درون و بیرون آن مرزها را می‌دهیم!” این‌ مسئله در سال 1948 بسیار مهم بود که جریان خبررسانی بین‌المللی نوپا بود و اینترنت هنوز داستانی علمی- تخیلی محسوب می‌شد. امروزه، حکومت‌ها اگر بخواهند جریان اطلاعات و نظرات در ورای مرزها‌ را متوقف کنند، باید تا اندازه خارق‌العاده‌ای پیشروی کنند. که البته بسیاری می‌کنند.

  1. I’m a little confused by the website, I wanted to start a discussion – but I’ll add to this instead.
    I don’t agree with the principle. I’m a bit surprised that anyone does! here in the UK I have a wide range of legal and social bans on what I can say. These bans are quite widely accepted and the free speech debate is to some extent a tool to criticise the values held by other non-western societies. Let me give some examples:
    1) Should I be free to publish information about a defendant on trial?
    2) Should I be free to name a rape victim? comment on his or her behaviour? while the case is in court?
    3) Can I publish research results on skin colour variation between races? [yes] Can I do the same about conginitive attributes? – not if I want a job in a UK or US University?
    4) Can I question the roles of men and women in modern society? And still be allowed conduct job interviews as part of my job?
    6) Can I talk openly about my religious views and evangelise?
    I’m not talking about National security issues, but that we have other widely accepted, largely unchallenged laws and social rules which threaten the careers, livliehood and freedom of transgressors. I don’t think India or Arab states have more rules, just different ones.
    In many cases the rules are well-meant and intended to support justice or promote admirable changes to society. But make no mistake, they stop free expression and publication of some information.

    An interesting initiative. Yet prior to embarking upon any endeavour, might it not prove prudent to precisely categorise the intention underlying the quest? As well as identifying what is, and what can be done to overcome, the greatest impediment to securing that desired accomplishment?
    In this case, is discussion the goal? Or is this merely a device, deployed toward attainment of an inestimably higher value outcome? Resolution of these queries, necessitates use of questions specifically designed to identify some fundamental requirement universal to us all. That effort then applied, coalesces as a single vector. Plus, exposure of an obvious but un-addressed flaw in our physiological construction. Which has, until now, frustrated major advancement for our kind.

    Q1. What is such a crusade intended to achieve?
    Potentially, there are as many responses to that conundrum as there are individuals to contrive them. Yet not one of those explanations, being wholly dependant or entirely reliant on the presence of humanity, can manifest without the existence of humanity. So, might ensuring the continuation of the species constitute the common purpose pursued?

    Q2. What prevents a realisation of the above?
    To function effectively in reality, human appreciations have to accommodate every aspect of existence they encounter. Else-wise, conflict will ensue from that plethora of disparate ‘understandings’ arrived at through selective appraisal. This inherent constructional defect is unfortunately not correctable. But what if, once registered in collective consciousness, it could be compensated for?

    Free Speech Disclaimer Prefacing All Principles Of Debate.
    I, in common with all other humans (evidence for concept available on application), am not ‘plugged’ directly into reality. But rather into an ‘interpreter’ interface, whose subjective output may be genuinely mistaken for said objective experience. Consequently, what follows is but a rendition of reality together with its associated workings. Additionally, given acknowledgement of the primary principle, debate is intended to ensure that those conditions conducive to species survival are maintained. Such that an inclination to suppress open discussion, as opposed to personally forswearing involvement in it, shall signify the presence of a closed ‘comprehension’. One that will not withstand comparative testing. Being likely to unnecessarily imperil species continuance, and by extension its own possessor’s longevity. (No humans, no debatable notional constructs, invented ideologies, pseudo philosophies, or any other homo sapien-powered activity).

    There are as many ways to explain a view as there are minds to interpret it. If any particular explanatory format cannot be assimilated, it is by no means the fault of an audience. All onus rests with the presenter. Who will and must, when requested, rework their mentation from as many differing perspectives as may prove necessary to achieve comprehension and reaffirmation. Truth alone is resilient to interminable debate. Which offers a clue as to why untruth is so desperate to avoid it.

    Example:
    “Professor states that democracy “always needs debate” and that the debate “plays its role” better if there are less limitations of free speech.”
    An opportunity once presented itself to ask a politician, if he considered it vital for someone in his position to possess a firm grasp of reality. He replied in the affirmative. The next query concerned whether he believed in democracy. His response confirmed that he did. When questioned as to what democracy was, he stated fairness. This prompted pointing out that a dictionary defines democracy as, “government of the people, by the people, for the people”. Or policy selection via majority mandate. So was expressing belief in something when one didn’t know what that something was, evidence of a firm grasp of reality? Sadly he was unable to spare time to even make an excuse, before fleeing.

  3. Adding ‘and able’ is a serious error. It opens the door to State intervention in the name of promoting freedom of expression which, as night follows day, will end up restricting it. No state willingly expends resources on promoting free speech without trying to stipulate the kinds of speech that its resources can be used for.

    Just listen to the politicians who insist that the right of free speech must be exercised responsibly. A fundamental right of free speech that protects only ‘responsible’ speech protects nothing worth having. Once those politicians are expending state funds to provide our internet connections the rest is inevitable.

    Please stick to the 1948 wording. For the internet, it cannot be bettered.

I totally agree with this statement, I believe that every person should be able to express their self, I believe that every person has a purpose in life, if you look around you everything has a purpose, the trees have a purpose, the birds have a purpose, all the animals have a purpose, so human beings surely have a purpose, and the wise man is he who finds his or her life’s purpose. Human Beings have two ears, and a tongue, to hear as twice as you speak is a good thing, this helps you learn more in order to interact properly. Without communication nothing would happen, so people must communicate and be able to express their selves freely

  6. Yes, we’re all humans, we make up the basic unit of society and therefore in order for society to be free, each individual within the society must also be allowed to be free.

    The idea of freedom as a right is quite strange because the concept of a right in itself is a myth. A right is simply a metaphysical idea that doesn’t protect one against anything. Of everything that happens there is only what comes to pass. If someone is arrested for assault it is not the right of the victim that is protected but simply the will of the government to punish. Should we have freedom? It would be nice but not our right.

  8. I’ve read recently an interview given by Professor Timothy Garton Ash for Polish magazine “Polityka” – titled “Dangerous Speech” but devoted to wider spectrum of free-speech-debate matters. Among other interesting statements, with majority of which I agree, Professor states that democracy “always needs debate” and that the debate “plays its role” better if there are less limitations of free speech. But what is this role to play – that is my question. Debate is considered a key attribute of democracy, but maybe sometimes is treated as democracy’s Sacred Cow. Is it really enough if only debate exists and continues in free and civilized manner? I’m skeptical about this. If debate hasn’t any other aim than exchange of thinking, one can expect its running wild and becoming useless (another danger for participants: GBS stated that in an exchange of thinking transaction he usually was the loser). I think that the most important factor essential for democracy as a system of majority rules, making debate sound, is a debate final aim: taking a decision by ballot, just by debating body. There is an opinion that natural extension – or rather 2.0 Variant – of the first watchword of modern democracy “no taxation without representation” is the formula “no obeying a decision without to vote on it” that can be fulfilled via Internet. I agree with this opinion, and I’m convinced that in this century cybernetic assisted direct democracy, with truly fruitful debates, will become real.   9. I highly agree with this principle, and I understand how the others branch of from this one. Therefore, it is a vital one to discuss and gain a better understanding about. Personal opinions and ideas is what shapes each person as an individual and without these the world would be an extremely uniform and monotonous place. Therefore it is crucial to be able to express and communicate these ideas, even when others do not agree. Of course I admit that this is unfortunately not always the case. But as stated, we need to have the power to be able to express as well as the will. This begins by appreciating what others have to say and at the same time having the ability to accept that your own opinion is just as good as any.

  11. Hi everyone, I’m the first who comments in this section. On the one hand, I do not understand how such a site is deserted by all who have the desire to communicate and share their thoughts with anyone, freely, but soon after, I realize that everything the web has fallen upon us with a so quickly that we do not have a clear vision of what the web, or what is the chance to express themselves freely. Freedom from whom? The concept of freedom is so far away that it is difficult and self-talk. Personally, I hope for a worldwide deployment of this platform to be, regardless of whether they agree on one or more themes.
