لا نطلق تهديدات بالعنف ولا نقبل الترهيب بالعنف.

أين هي الحدود؟

المادة العشرين من العهد الدولي الخاص بالحقوق المدنية والسياسية تقول ان يجب على الدول ان تمنع “أية دعوة إلى الكراهية القومية أو العنصرية أو الدينية التي تحرض على التمييز أو العداوة أو العنف”. هذه العبارة ليست واضحة تماما وتترك مساحة كبيرة لتفسير ما معناها. الولايات المتحدة تضع سقفا عاليا لماذا تعتبر تحريض على العنف. في ما يسمى “اختبار براندنبورغ” (بعد قضية المحكمة العليا بين ولاية أوهايو ضد براندنبورغ)، تم تعريف الشروط لما يعتبر تحريضا على الفنف: يجب ان يكون مقصود، محتمل ووشيك. مجموعة أخرى من الديمقراطيات الليبرالية الناضجة لديها شروط أقل وتجرم كل من التهديدات العمومية العنيفـة وأنواع التعبير التي تحرض على الكراهية أو العداوة.

كل ما يتعلق بحرية التعبير يعتمد على السياق ونبرة الصوت إلى حد كبير. المفكر الإنجليزي الليبرالي جون ستيوارت مل مشهور بقوله أننا يجب أن يكون لنا الحق ان ننشر مقالة في صحيفة ونقول ان تجار الذرة يجوعوا الفقراء ولكن ليس لنا الحق لايصال نفس الرسالة إلى حشد متحمس متجمع أمام منزل تاجر الذرة . (اليوم نقول نشاط بنوك الاستثمار.)  وعندما قراء صحيفة الجارديان البريطانية يروا في الصفحة الأولى: “تشارلي بروكر: اقتلوا سيمون كويل، وتبرعوا بالكرواسان”، هم لا يقرأون هذا العنوان كتحريض على القتل بل هم يعرفون انه دعابة. عندما الدكتاتور الليبي معمر القذافي هدد الشعب انه سيذهب الى مدينة بنغازي ويقضي على “ممر ممر”، مبينا “بدون رحمة”، يعرف الجميع انها ليست دعابة.

حالة متطرفة من خطاب يحرض على العنف هي إذاعة وتلفزيون ليبر دي ميل كولين في رواندا، مما شجع عصابات من الهوتو على قتل نحو ٨٠٠،٠٠٠ توتسي (والهوتو المعتدلين)، من خلال الدعوة المتكررة عبر موجات الأثير “لالحرب النهائية” إلى “إبادة الصراصير.” حتى لو كنت تعتقد أن ينبغي أن نكون احرار في وصف مجموعات أخرى من الناس باسم “الصراصير” (انظرإلى المبدأ الرابع)، كما في تقليد التعديل الأول للدستور الأميركي، لكن مهما كان ستعتقد ان كان ينبغي إيقاف هذه المذبحة.

السياق أيضا يعني: هل لديك تلك وسائل الإعلام المتنوعة المفتوحة التي نتحدث عنها في المبدأ الثالث؟ يمكن ان خطاب الكراهية يقابل بخطاب ايجابي في وسائل الإعلام المؤثرة الأخرى. علق مراقب وهو يحاول ان يفسر النزعة الوحشية في صربيا تحت الدكتاتور المنتخب سلوبودان ميلوسيفيتش،  “تصوروا لو كانت الكلو كلوكس كلان اتخذت السلطة على جميع قنوات التلفزيون الرئيسية في الولايات المتحدة خلال الخمس سنوات الماضية. ” سوزان بنش تعمل على تطوير اختبار متكون من خمس أجزاء لتحديد متى يتحول خطاب الكراهية إلى “كلام الخطير” بمعنى الكلام الذي سيؤدي على الأرجح إلى أعمال العنف.

 نحن نتحدث هنا أساسا عن العنف من قبل الأفراد والجماعات وليس الدول. على الرغم من أن المادة العشرين من العهد تنص أيضا بشكل قاطع أن “يحظر على أي دعاية للحرب بموجب القانون،” قلة قليلة من البلدان لديها قوانين تمنع حكامهم من نشر دعاية للدخول في حرب (لكن بعض الدول لديها قواعد بشأن الكيفية التي ينبغي أن تدخل في حرب).

ضد حق اعتراض القاتل

مثل المبادئ الآخرى، ليس المقصود هنا أن نحدد بدقة ما القانون ينبغي أو لا ينبغي ان يمنع. بل هو مبدأ من حكم التجربة لإرشاد سلوكنا. المبدأ متكون من جزأين: اولا، لا نسمح للتهديدات بالعنف. وثانيا، نحن لا نسمح أو نقبل أو نتنازل للترهيب العنيف. هذه النقطتين مترابطين للغاية. إذا كنت توافق على تهديد واحد من العنف، فتشجع  تهديدات آخرى. تخيل هذا الموقف: المجموعة الأولى، التي لديها مشاعر قوية نحو منع قول أو تصوير اشياء معينة، تقول لنفسها: “آه، هذه المجموعة الثانية حصلت على توقيف شيء من خلال تهديد للقيام بأعمال عنف، ونحن يجب علينا أن نفعل نفس الشيء”.

ما كتب حول حرية التعبير يتضمن مفهوم  حق المقاطع للفيتو, وهذا المفهوم الآن يعتبر من طراز قديم.  إذا نسمح للمقاطعون في اجتماع بالصراخ بصوت عال باستمرار، فإنهم ينكرون حق المتكلم على الكلام. لكن في هذه الأيام، ونحن نرى حق القاتل للفيتو. أفراد أو جماعات ترسل هذه الرسالة البسيطة: “إذا قلت ذلك سوف نقتلك.” احيانا لا يتخلوا عن وعدهم. وقد قتل المئات من النساء والرجال في جميع أنحاء العالم لقول أشياء – كتاب عن المافيا، النقاد والساخرين من عدة أديان والأنظمة، المعارضين، رسامين وناشرين روائيين وصحفيين محققين. المزيد من الناس تعيش خائفة من هذه التهديدات بسبب ‘حق القاتل للفيتو’.

التخويف والاسترضاء

كل من نصفي هذا المبدأ لديهم وزنا متساويا. يجب علينا مقاومة التهديدات بالعنف كما يجب علينا أن لا نصدر تهديدات. الكثير الدول التي يسمى حرة سيئة للغاية في هذا المجال. مرارا وتكرارا هذه الدول أصرت على استرضاء تهديدات صريحة أو ضمنية من العنف – في بعض الأحيان بسبب “الاحترام” للدين (انظر إلى المبدأ السابع)، “تماسك المجتمع”، “النظام العام” أو “التعددية الثقافية” – بدلا من محاربة جميع التهديدات بقوة القانون بعزم مجتمع موحد.

مثال كلاسيكي من الاسترضاء وقع مؤخرا من جانب الناشري الأمريكي مطبعة جامعة ييل. وكانت جامعة ييل على وشك نشر كتاب علمي وخطير جدا كتبه الأستاذ جايتي كلاوسن حول الرسوم الدنمركية للرسول محمد واسم هذا الكتاب هو “الرسوم الكاريكاتورية التي هزت العالم.” وأعدت حزمة من الرسوم لاستنساخ صفحة كاملة في صحيفة يولاندس بوستن الدنمركية التي ظهرت فيها الرسوم الساخرة، بحيث ان يمكنك أن تراهم في سياقهم الأصلي، وأيضا تم استنساخ التصوير السابق للرسول محمد في الفن الغربي والإسلامي لإعطاء منظور تاريخي واسع. قبل وقت قصير من تاريخ نشر الكتاب، قررت جامعة ييل وصحافتها لسحب الرسوم. الشيء الوحيد الذي لا يمكن للقارئ أن يراه الآن في كتاب يسمى الرسوم الكاريكاتورية التي هزت العالم هو… الرسوم الكاريكاتورية التي هزت العالم.

في بيان الناشر ذكر “خبراء في المخابرات والأمن الوطني  وتطبيق القانون، والمجالات الدبلوماسية، وكذلك كبار العلماء في الدراسات الإسلامية ودراسات الشرق الأوسط”، الذين أعلنوا أن عبر إعادة نشر الرسوم الكاريكاتورية، الصحافة “واجهت خطر جدي من التحريض على العنف.” وقال مدير مطبعة جامعة ييل جون دونتتش أنه لم ابدا يتهرب من الجدل “ولكن عندما وصل الأمر إلى وضع الدم على يدي لم يكن هناك شك”.

هذه ليس مجرد حجة مشوشة، لكن المسألة معكوسة تماما. ليس تكون مطبعة الجامعة هي من “تحرض على” العنف، ولكن أولئك الذين يهددوا استخدام عنف كرد على تصرفات الجامعة المعقولة. في حال اتخاذ إجراءات عنيفة، انه ليس دونتتش الذي سيكون له “دم على يديه” ولكن أولئك الذين ارتكبوا أعمال العنف. يجب ان نفرق بين الضحية والجاني بوضوح. اذا صحافة جامعة عظيمة لم تكن مستعدة لنشر تلك المواد بدراسة علمية ثم انتصر التخويف العنيف. للأسف هناك أمثلة كثيرة في وسائل الإعلام والفنون والمجتمعات المحلية في بعض الدول الحرة في العالم – ناهيك عن الدول الأقل اوغيرحرة.

حالة قانونية إنجليزيية من سنة ١٨٨٢ تضيء على الارتباك. قبضت الشرطى على مجموعة من جيش الإنقاذ لاجراء مسيرة. ولكن  عدة مرات من قبل جماعة معارضة بالاسم المجيد الجيش الهيكل العظمي قد انقطعت هذه المسيرة بعنف. عقدت المحكمة الإنجليزية أن الشرطة يجب أن تمنع الجيش الهيكل العظمي الذي كان يهدد بالتخويف العنيف، ليس وجيش الخلاص الذي كان هدفا لذلك التخويف. ويمكن تعميم هذا الحكم لكل قارة في عصرنا: لا تمنع الإنقاذ، بل امنع جيوش الهيكل العظمي!

الشجاعة والتضامن

مقاومة التخويف العنيف تتطلب دقة القانون الكاملة. فهي تتطلب من الشرطة ان تحمي المهددين بدلا من طلب منهم أن يصمتوا. كما انها تحتاج الى شجاعة استثنائية من الأفراد الذين خاطروا أحيانا بحياتهم من أجل حرية التعبير:مثل الصحفية الروسية آنا بولتكوفسكايا، وحاكم ولاية بنجاب سلمان تسير، والصحافي التركي الأرمني هرانت دينك، والناشط البيئي البرازيلي شيكو منديس. لا يمكننا أن نبدأ في سرد كل اسم ولكن الرجاء ضف أسماء هنا، مع شرح الاسباب لماذا تعتقد أنهم ينتمون هذه الفة المشرفة.

لا يمكن أن نتوقع من هؤلاء الأفراد الشجعان فعل ذلك من نفسهم، كما لا يوجد دولة تستطيع ان تفعل ذلك من نفسها. وهناك عنصر ثالث حيوي وهو تضامن من المجتمعات والجماعات. كل ما المزيد من الناس تشارك في تحمل عبء التخويف، كل ما يصبح هذا العبء اصغر. وعندما وقف خالد الجهاني رجل وحيد للتعبير عن رأيه في المملكة العربية السعودية انتقل بعيدا إلى السجن. ولكن عندما نصف مليون نفر وقفوا جنبا إلى جنب في ميدان التحرير في القاهرة،تنحى الرجل الذي كان يحرض على العنف، الرئيس حسني مبارك.

هذا التضامن لا يتطلب الاتفاق مع وجهات نظرالمعارضين. بما ان المعارضين غالبا لديهم وجهات نظر قوية و تختلف بين شخص لآخر، فمن المستحيل منطقيا أن نتفق مع كل واحد منهم. على سبيل المثال، لا يمكنك ان تتفق باستمرار مع الرؤية لمستقبل روسيا التي عبرعنها هؤلاء المعارضين العظماء لالاتحاد السوفياتي، الكسندر سولجينتسين وأندريه ساخاروف، لأنهم اختلفوا يطريقة اساسية، ولكن يمكنك أن تقف متضامن معهم بطريقة متساوية. هناك جملة شهيرة منسوبة الى فولتير: “أنا لا أتفق مع ما تقوله، ولكنني سوف ادافع إلى الموت عن حقك لقول ذلك”. في الحقيقة  فولتير لم يقل هذه الخملة ابدا – قدم هذا المثل كاتب سيرة في اول القرن العشرين  – ولكن روح ملاحظته صحيحة تماما. نحن بحاجة لهذه الروح في الوقت الحالي أكثر من أي وقت في الماضي.

على الرغم من وجود هامش للتفسير من حالة إلى أخرى ومن سياق إلى سياق، هذا هو احدى أبسط مبادئنا. كما أنه احدى اصعب المبادئ للتنفيذ. يمكن أن تقتل لو التزامت به.

    I don’t know a great deal about all this and I’m sort of rushing through with a speed read and a quick reply. I think there are different varieties of violence, and sometimes a mixture of those varieties. I am of the strong belief that some people are inherently more violent than others, for medical reasons. Their childhood can be a big part of things. What I would call social leisure violence, such as football hooliganism, is a particular type that has spread out with the advance of media technology. War is another type of violence which is state organised, which tends to be re labeled and glorified as much as possible. Where government are involved, there many fine speeches made and many new words for violence used. Guantánamo Bay for example was an act of pure highly organised violence and false information that inhibited free speech. This together with the tenure of President Trump has set new values; or the lack of them. The global population has always been about the have and have not. Technology has taken us a long way, but greed and violence will increase across the world. Drugs and alcohol are certainly a major factor in the Streets of the UK where I live and no doubt across much of the world.

  3. The internet is an amazing innovation with no precedent and any limitations upon it would be a shame. To limit it slightly would be to set in action a cascade of fetters that would shatter everything the Internet could have been.

If we think of what the idea of the internet was in the beginning, the vastest storage of information shared among the whole world, of course it is normal to assume that it would become a vastest opportunity for innumerate crimes. But the basic idea, the true meaning of the whole invention is so valuable and must be absolutely preserved.
    Between the concept of abuse and freedom of speech there’s sometimes a very thin line, but it is always more important to say it all than to oppress ideas.
    Liberty that has been given to some of the big, like Google, and their “privacy respect” is always questionable, like it happened these days in GB, with admitting that Google car has been collecting (and selling) more info than actually needed for “filming the streets”.
    Any clerk with access to information, can always be willing to sell them for a good offer (remember the Swiss bank account holders’ information scandal…). It is just something that can not be stopped. But it must be fought and punished.
    We all deserve to see/read/hear everything that might (or even that might not) interest us, and judge ourselves upon it. Let’s try to keep it that way.

  5. I share the importance of preventing the abuse of the content , however like in the comment above the dilemma of what should be considered as an abuse and who should define it is a big deal. And I think there is division in term of the priorities around that world. In the developed countries where there is a reasonable freedom of speech the abuse from the private side is more of an issue than in those countries where there is a constant state repression of the freedom of expression online. Moreover, this type of control does not guarantee protection of the other forms of abuse like child pornography. Thus I believe we the netizens should aim for liberating the online space to allow as much freedom of opinion expression as possible, even if it is at the cost of the abuse.

    • I agree with you that we have to consider different countries and their cultures. It is very hard to generalise the principles, because it may be that some parts of the world have a completely different view than other parts. So it is quite a challenge to agree on ten principles globally and it is also interesting. I also agree that we have to try to have media which are as open as possible, but I disagree with you that it is even at the cost of the abuse. We have to differentiate between the freedom of speech and abuse. Therefore we have to define principles globally in order to be able decide globally whether this “speech” is accetable or an abuse.

      Ich stimme Dir zu, dass wir verschiedene Länder und deren Kulturen berücksichtigen müssen. Es ist sehr schwer, die Prinzipien zu verallgemeinern, weil es sein kann, dass einige Teile der Welt eine ganz andere Meinung als andere Teile haben. So ist es durchaus eine Herausforderung, auf zehn Prinzipien global zustimmen und es ist auch interessant. Ich stimme auch zu, dass wir versuchen, die Medien so offen wie möglich halten müssen, aber ich stimme Dir nicht zu, dass es auch um den Preis des Missbrauchs ist. Wir müssen zwischen der Freiheit der Rede und Missbrauch unterscheiden. Deshalb müssen wir Prinzipien global definieren, um in der Lage zu sein zu entscheiden, ob diese global “Rede” annehmbare oder ein Missbrauch ist.

  6. The question of legitimacy is indeed very tricky.
    Public powers should indeed have the power to ‘legitimately’ restrict certain information. Taking an extremely libertarian approach claiming that all information should be ‘free’ is far from the pragmatic reality.
    I would even argue that as the question of legitimacy is such a delicate question that it is virtually impossible to define it in a general principle. When using a phrase like ‘for the greater good of the public’ to define the legitimacy of restricted information, executive powers might however be prone to exploit this principle.

  8. I’m here to tell the denied freedom of the press in Italy. This is a real problem.
    The censorship has reached unbearable levels! After the Treaty of Lisbon and the approval of the ACTA treaty, by the European Union, the only resource we have left to procure a real informaizoni is the net…but it also wants to censor the web!
    The project began long ago and came to the public through the bills SOPA and PIPA at the U.S. Congress. In Italy two politicians have already tried to censor the web through the fight pro-copyright.
    It’s necessary that we speak.

    This explanation appears a particularly net-centric view for a principle that includes “all other forms of communication” ?

    And, why the overly complicated language regarding corruption – “illegitimate encroachments” – why not just corruption. In seeking to define, a principle should not be limited by complexity.
